POWERBIZ® Platform
POWERBIZ® is a "real-time" platform that uses technology to identify, understand, qualify, engage, interact, and convert the VISITORS/USERS of the e-commerce or portal of our PARTNERS/CLIENTS, with the aim of improving and personalizing the experience of their customers, users, and visitors.
As a tool that only complements and adds functionality to the portals and e-commerce of PARTNERS/CLIENTS, POWERBIZ® does not have any website, portal, or e-commerce that interacts directly with the VISITOR/USER, nor does it directly operate the platform or have control over the collected data. Therefore, we provide a specific PRIVACY POLICY for our PARTNERS/CLIENTS, who must adapt or create their own privacy policies for the knowledge and acceptance (or rejection) of their VISITORS/USERS.
General Information
This Privacy Policy contains information regarding how we process, in whole or in part, in an automated or non-automated manner, the personal data of VISITORS/USERS who access the POWERBIZ® platform through the portals and e-commerce of PARTNERS/CLIENTS.
This Privacy Policy has been prepared in compliance with Federal Law No. 12,965 of April 23, 2014 (Brazilian Internet Civil Framework - Marco Civil da Internet), Federal Law No. 13,709 of August 14, 2018 (Brazilian General Data Protection Law - LGPD), and EU Regulation No. 2016/679 of April 27, 2016 (General Data Protection Regulation - GDPR).
This Privacy Policy may be updated due to any eventual regulatory updates, which is why the "beneficiary/user" is invited to periodically consult this section.
Ownership and Use of Data and Information
The POWERBIZ® platform, through the operation of its PARTNERS/CLIENTS, stores and holds custody of the information of VISITORS/USERS, which is owned by, and for the specific use and destination of, the PARTNER/CLIENT that collected it, who holds the role of Controller, Processor, and Data Protection Officer (DPO).
The POWERBIZ® platform is intended solely for the function of collecting, storing, safeguarding, and protecting the information of VISITORS/USERS, so that the PARTNER/CLIENT can interact with them in the most personalized and assertive way possible, creating a better browsing experience.
Although the POWERBIZ® platform provides technological means for interaction and communication with VISITORS/USERS, this only occurs through the direct operation and configuration by the PARTNER/CLIENT, with or without the support of the POWERBIZ® team, who must do so in accordance with their Privacy Policies available on their own portals or e-commerce, read and accepted by VISITORS/USERS.
The retention period of information, as well as its deletion—whether spontaneous or requested by VISITORS/USERS—will be the sole responsibility of the PARTNER/CLIENT. The POWERBIZ® platform is only responsible for providing functionalities that allow their configuration and operation.
The POWERBIZ® platform does not share specific or identifying data of VISITORS/USERS among its PARTNERS/CLIENTS or with other entities, but it may obtain information from third parties to make it available to platform users as complementary information.
Only in cases of law enforcement, to meet legal requirements, including compliance with court orders, discovery requests, valid subpoenas, and other appropriate legal mechanisms, will the sharing of information be necessary.
The use of data directly by the POWERBIZ® platform, independent of the PARTNER/CLIENT, will occur solely and exclusively for statistical and benchmarking purposes, containing no personally identifiable information or anything that could in any way link the data or information to VISITORS/USERS.
The PARTNER/CLIENT utilizing the POWERBIZ® platform may, of their own free will and decision, configure it to send collected data to other tools or platforms. It is the responsibility of the PARTNER/CLIENT to ensure that these other tools are appropriate and aligned with the privacy policy presented to and accepted by the VISITOR.
Collected Data and Information
POWERBIZ® collects and stores information defined and configured by the PARTNER/CLIENT who owns the portal or e-commerce, such as:
- name, email address, physical address or postal code, payment method, and telephone number;
- information about your computer, smartphone, and other devices used to access the PARTNER/CLIENT's service, such as smart TVs and mobile devices;
- details about your interactions with customer service, such as the date, time, and reason for contact, transcripts of chat communications, and, in the case of calls, your phone number;
- device IDs or unique identifiers, device and software characteristics (such as type and configuration), connection information, page view statistics, referral URLs, IP address, and standard Internet log data;
- ad data, such as information about impressions delivered to a cookie, the URL of the site where the impression was delivered, as well as the date and time;
- and supplementary information such as demographic data, location data, interest-based and internet browsing behavior data, and others defined and configured by the PARTNER/CLIENT to improve the experience of their VISITORS/USERS.
- sensitive data, such as passwords and credit card numbers, and other information deemed sensitive, such as account balances, document numbers, transaction details, can be configured by the PARTNER/CLIENT not to be captured, processed, or stored by the POWERBIZ® platform.
The POWERBIZ® platform is provided to the PARTNER/CLIENT, in its default configuration, with proper ANONYMIZATION of sensitive information to meet the general requirements of the LGPD. However, the PARTNER/CLIENT may alter these settings, making requirements more stringent or relaxed, in order to meet the specific needs of their own privacy policy, whether more or less permissive, given the operational requirements or international laws such as the GDPR.
Security of Data and Information
Our team follows strict security standards, taking appropriate measures to protect the Data and Information of VISITORS/USERS against unauthorized use, access, alteration, and destruction.
As a platform for direct use and operation by our PARTNERS/CLIENTS, where they have privileged access via username and password, it is their responsibility to safeguard and prevent unauthorized access through their identities and passwords.
We reiterate that sensitive data, such as passwords and credit card numbers, as long as properly configured by the PARTNER/CLIENT on their portals or e-commerce, will not be captured, processed, and stored by the POWERBIZ® platform.
Technologies used in the POWERBIZ® platform
The POWERBIZ® platform uses cookies and other technologies, such as web beacons, to facilitate your access to the services of our PARTNERS/CLIENTS, allowing us to recognize the VISITOR/USER each time they return to the portals and e-commerce.
Cookies are small data files, typically stored on your device while you browse and use websites and online services. Cookies are widely used to make websites work more efficiently, as well as to generate information, reports, and help personalize the service.
Web beacons, also known as clear gifs or pixel tags, normally work in conjunction with cookies for similar purposes on the portals and e-commerce of our PARTNERS/CLIENTS, such as understanding and enhancing usage, improving site performance, and monitoring the actions and traffic of VISITORS/USERS. Since web beacons typically work in conjunction with cookies, in many cases, rejecting cookies will prevent the effectiveness of web beacons.
We use other cookie-like technologies, such as browser storage and plugins (e.g., HTML5, IndexedDB, and WebSQL). Like cookies, some of these technologies can store small amounts of data on your device. We may use these and other technologies for purposes similar to cookies, such as to enforce the use of our terms, prevent fraud, and analyze service usage. There are several ways to exercise your choices regarding these technologies. Recommendations to Partners/Clients of the POWERBIZ® platform
To PARTNERS/CLIENTS using the POWERBIZ® platform, it is always suggested that they follow the laws and regulations relevant to the countries where they operate, including the Brazilian Internet Civil Framework, LGPD, and GDPR. It is also recommended to include in their privacy policies a mention of the use of third-party tools, specifying their details and functionalities.
Changes to this Privacy Statement
We may periodically change this Privacy Statement to comply with changes in legislation, regulatory, or operational requirements. We will communicate any changes as required by law. Continued use of the POWERBIZ® platform by PARTNERS/CLIENTS after such changes and communications will constitute acceptance thereof.
